Recovering Money

You can use this guided pathway if:

• you are a
  small business

  ?

  A small business is defined by its number of employees and its annual revenue. For more information see Small business on the Australian Securities and Investments Commission (ASIC) website.

  trying to recover money from another business or person
• you are person trying to recover money from a small business or another person.

If you own a small business you may have a dispute with another business or person about:

• an unpaid invoice for supplying goods or providing a service
• a breach of contract where you lost money.

If you are a person you may be owed money for: 

• lending money to a friend or family member
• goods that were damaged, lost or not returned by someone.

There are various ways you can try to resolve your dispute without going to court.

This guided pathway:

• only applies to contracts and agreements made in NSW or where the goods were supplied or services provided in NSW, and for claims for less than $20,000
• may not apply to some small businesses in certain industries
• does not have information about resolving disputes about goods or service provided to you by a business - you may have a claim under Australian consumer laws. For more information, see Buying products and services on the Fair Trading NSW website.
